PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE MAKING A PURCHASE OF OUR PRODUCTS OR SERVICES. By purchasing any of our products or services, you acknowledge and agree to the terms and conditions set forth below.
OWNERSHIP OF THE PRODUCT OR SERVICE
Once the total price of the product or service has been paid, the customer acquires ownership of it. This means that you have the right to use, enjoy and dispose of it. In the case of services, there is no physical transfer of goods. Instead, these are rights and obligations associated with the service.
ACCEPTANCE
These Terms and Conditions are considered reproduced in any Order or Purchase Order or Services issued by SOUND ROUND PRODUCTIONS INC. These Terms will be considered accepted upon acceptance of the Order by the company or at the time the company performs any act aimed at fulfilling the provision of services or supply of equipment and/or products.
PURCHASE ORDER
It is the legal document used in commercial transactions to request the acquisition of goods or services from SOUND ROUND PRODUCTIONS INC. This order is issued by the buyer and details the products or services required, quantities, specifications, terms and conditions.
RISK OF LOSS
All purchases of physical items from SOUND ROUND PRODUCTIONS INC. are made pursuant to a shipping contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
RETURNS, REFUNDS AND TITLE
SOUND ROUND PRODUCTIONS INC., does not assume ownership of returned items until they arrive at our fulfillment center. At our discretion, a refund may be issued without the need for a return. In this situation, SOUND ROUND PRODUCTIONS INC., does not assume ownership of the refunded item. For more information about our returns and refunds, please contact us.
PRODUCT DESCRIPTIONS
SOUND ROUND PRODUCTIONS INC., tries to keep product descriptions as accurate, complete, and reliable as possible. If a product offered by SOUND ROUND PRODUCTIONS INC., is not as described, your sole recourse is to return it unused.
PRICES
“List Price” means the suggested retail price of a product provided by a manufacturer, supplier, or seller. We periodically check list prices against prices recently found at SOUND ROUND PRODUCTIONS INC., and other retailers. Certain products may have a “Previous Price” displayed, which is determined using the product’s recent price history on SOUND ROUND PRODUCTIONS INC. With respect to items sold by SOUND ROUND PRODUCTIONS INC., we are unable to confirm the price of an item until you place the order. We generally do not charge your credit card until your order has entered the shipping process or, for digital products, until we make the digital product available to you.
PROMOTIONAL OFFERS
From time to time, we may make special offers on promotions and/or plans (“Offers”). SOUND ROUND PRODUCTIONS INC. determines eligibility for the Offer in its sole discretion, and we reserve the right to revoke an Offer and suspend your account if we determine that you are not eligible. We may use information such as the device ID, payment method or email address of the account used at SOUND ROUND PRODUCTIONS INC., to determine Offer eligibility. Eligibility requirements and other limitations and conditions will be disclosed to you when you subscribe to the Offer or in other communications made available to you.
DISPUTES
PLEASE READ THIS SECTION CAREFULLY BECAUSE IT REQUIRES YOU TO ARBITRATE DISPUTES AND LIMITS THE WAY YOU CAN SEEK HELP. Any dispute or claim relating in any way to the terms and conditions for the purchase of any product or service sold or distributed by SOUND ROUND PRODUCTIONS INC., or through this website, will be resolved by binding arbitration, rather than in a court, except that you may assert your claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to the Terms of Use. We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than arbitration, we each waive any right to a jury trial. Additionally, we both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights. THIS PROVISION IS VOID, INAPPLICABLE OR UNENFORCEABLE IN THE STATE OF NEW JERSEY.
GENERAL TICKET PURCHASE CONDITIONS
By accepting the Terms and Conditions of the Ticket Sales Service (hereinafter the “TCB”), the Buyer, the Producer and SOUND ROUND PRODUCTIONS INC., undertake the following terms:
BUYER’S DECLARATIONS
The “Buyer”, understood as the person who purchases a ticket through SOUND ROUND PRODUCTIONS INC., understands and accepts that:
SOUND ROUND PRODUCTIONS INC., is a legally authorized ticket office operator for public performances, concerts, sporting events, conferences or others (hereinafter the “Events” or the “Event” as applicable).
SOUND ROUND PRODUCTIONS INC., sells Event tickets by order of its organizers (hereinafter the “Producers” or the “Producer” as applicable), whose name is indicated in the information of each Event.
SOUND ROUND PRODUCTIONS INC., only sells the Event ticket office, so it is a third party unrelated to its organization. Consequently, it is not responsible for the modification, postponement, cancellation, price changes, rescheduling, quality, content, acts or consequences derived from the Event, as these are decisions that depend on the Producer. Except in cases where SOUND ROUND PRODUCTIONS INC. is the producer of its own events.
SOUND ROUND PRODUCTIONS INC., provides comprehensive customer service, which is independent of the development of the Event. To cover the costs of customer service, software licenses, payroll, public services, among others, SOUND ROUND PRODUCTIONS INC. charges a service charge, as established in the TCB.
All information about the Event published on the SOUND ROUND PRODUCTIONS INC. website. such as number of tickets, locations, ticket price, access conditions, dates, times, and other characteristics of the Event, has been provided, so the Client’s purchase decision has been based on it.
The information about the Events published by SOUND ROUND PRODUCTIONS INC. is provided by the Producers, who may eventually modify it, in which case SOUND ROUND PRODUCTIONS INC., in its capacity as agent, will inform on the website and at the assigned ticket offices. these changes. SOUND ROUND PRODUCTIONS INC. will not be responsible for the modification of the conditions of the Event that are ordered by the Producer. Except in cases where SOUND ROUND PRODUCTIONS INC. is the producer of its own events.
The purchase of tickets is subject to the approval and verification of the transaction by the bank, or financial entity, through which the Buyer makes the purchase, as well as the verification of the data.
SOUND ROUND PRODUCTIONS INC. does not control in any way the pages of the payment methods or payment gateways through which transactions are made. In this sense, SOUND ROUND PRODUCTIONS INC. will not be responsible for the processing of the information that the Buyer provides to these pages, to the payment methods or to the financial entities to carry out said transactions. The latter are responsible for the terms and conditions reported on their pages. Except in cases where SOUND ROUND PRODUCTIONS INC. is the producer of its own events; in which case you must review the TERMS OF USE and the PRIVACY POLICIES of SOUND ROUND PRODUCTIONS INC. When the ticket purchase is completed successfully, the invoice, the detailed payment receipt for concepts and the purchase confirmation number will be sent to the email provided by the Buyer.
For security reasons, only those who prove that they are the owners of the account that generated the purchase or the owner of the financial product that made it may exercise the rights established in the TCB and the current applicable legislation.
The Client’s account will be associated with the email validated by the Client, which cannot be modified unless there is a request from the Client for the account, after validation of the entity by SOUND ROUND PRODUCTIONS INC.
The purchase of tickets will be subject to the payment of taxes, fees and contributions according to current applicable legislation.
CONDITIONS FOR ENTRY TO THE EVENT
Entry to the Event is conditional on the presentation of a valid ticket (physical or digital), and the security inspection of the attendee and their objects by security personnel. Security personnel may deny access to the Event when they have reasonable grounds to do so.
The ticket will only be valid for the Event on the date, location and time indicated therein. The number of tickets, as well as the data contained in each of them corresponding to the Event, were selected directly by the Buyer.
The Buyer will decide their location within the Event, and will consider situations such as health conditions, pregnancy or disability, as applicable, when making their purchase, assuming the risks that may arise from an event with massive influx.
Access will be denied if the ticket is invalid or if event rules regarding personal items that can be brought in are not followed.
The Buyer must keep their printed ticket, hard ticket, or bracelet at all times during the Event.
SERVICE CHARGE
The Buyer understands and accepts that, for the acquisition of the ticket, SOUND ROUND PRODUCTIONS INC. provides the service of ticket generation and customer service and undertakes to:
Process the purchase made by the Buyer in the system.
Perform the Buyer’s registration process properly.
Provide the service of conservation and security of the conditions selected for each of the tickets purchased by the Buyer.
Generate mechanisms to prevent the impersonation of the Buyer.
Make available to the Buyer all customer service support on an ongoing basis, and all information channels of SOUND ROUND PRODUCTIONS INC., to keep the Buyer informed of the events, conditions, restrictions, modifications, details and general data related to the Event so that he/she can access the complete information required.
Attend to all requests, complaints, and claims presented by the Buyer within a term that may not exceed thirty (30) business days. If the Buyer files a request, complaint or claim, SOUND ROUND PRODUCTIONS INC., will send within three (3) business days an electronic communication informing the Buyer of the resolution of its case.
The provision of the above services will generate a Ticket Office Service Charge as remuneration from SOUND ROUND PRODUCTIONS INC., which is different from the amount of access to the Event, the ticket buying and selling service and customer service different from the Event, although they are complementary services.
The Ticket Service Charge and its value are disclosed to the Purchaser in the purchase process, and on the ticket. It is up to the Ticket Buyer to decide freely and voluntarily whether to accept these terms and conditions of payment of the corresponding value in order to obtain the services to which SOUND ROUND PRODUCTIONS INC., is obligated.
OTHER CHARGES
The Buyer must assume the additional cost generated if payment is made through platforms that charge a commission for their service. RETURNS AND EXCHANGES POLICY – LEGAL GUARANTEE SOUND ROUND PRODUCTIONS INC., undertakes only in the following cases with the Buyer to return the price paid for Access to the Event:
In case of cancellation of the Event (understanding when it has not started). The Buyer must follow the procedure that SOUND ROUND PRODUCTIONS INC. indicates to request a refund.
In the event that the Event is postponed and/or its date or venue is rescheduled. The Buyer must follow the procedure that SOUND ROUND PRODUCTIONS INC. indicates to request a refund within the period indicated by SOUND ROUND PRODUCTIONS INC. If the time has elapsed until the new scheduled date, without the refund being requested, it will be understood that the Buyer agrees with the new scheduled date, and the refund will not proceed.
In no other case will SOUND ROUND PRODUCTIONS INC., make exchanges or returns.
The Buyer understands and accepts that the following are not grounds for refunding the money:
Failure to enter the Event for reasons not attributable to SOUND ROUND PRODUCTIONS INC., or the Producer.
Due to loss, deterioration or destruction of the ticket, therefore, it is the Buyer’s responsibility to take care of and safeguard their ticket. Except, when the Buyer proves that he made the ticket purchase, that no person has entered the show with that ticket; and the cancellation of the lost, damaged or destroyed ticket is possible, SOUND ROUND PRODUCTIONS INC., may make the change.
If the Event is cancelled, postponed, or suspended (when it has started and cannot be continued) due to force majeure, fortuitous event, or legal or material impediments, no refund will be issued.
The following are events beyond the control of SOUND ROUND PRODUCTIONS INC., and do not generate a refund of the value of the ticket paid by the user: illness, disability, surgeries, family and relationship conflicts, or the death of the Client or a relative of the Client, the cancellation of flights or hotel reservations, force majeure Events that do not prevent the Event from taking place.
TICKET TRANSFER
The user who receives a TICKET/TICKET declares and accepts the following:
Understand that the ticket transfer tool is not a mechanism for ticket resale, so it should only be used for transfers between trusted people.
You understand that the use of the transfer tool for ticket resale activities constitutes an inappropriate use of the platform, which voids the legal warranty.
Understand that, if the value of the tickets is not paid for any reason, the transferred tickets will be canceled due to breach of the ticket purchase contract.
